New tariffs from AKEP, reacts to Telekom and Vodafone Albania

Following the denunciation by Albanian.com and Report TV regarding the lack of transparency by AKEP, for the new telecommunication tariffs starting from 1 March 2018, the reaction of two large mobile operators, Telecom and Vodafone Albania.

The two operators accuse AKEP of applying discriminatory tariffs to them. "Vodafone Albania considers AKEP's proposal as unacceptable due to lack of transparency. The proposal, which AKEP intends to approve, has not been communicated or consulted with other operators in the market, although the law clearly states that any regulatory measure affecting their operators and clients applies only after a public and transparent consultation " reads the response from Vodafone and Telekom Albania to the media.

Vodafone Albania response
Quite surprisingly, Vodafone Albania was informed by the media that AKEP (Electronic Communications and Postal Authority) will propose for approval in no transparent manner, an arbitrary decision favoring Albtelecom to the detriment of other operators' customers. According to this decision AKEP intends to apply discriminatory tariffs to Vodafone Albania and Telekom Albania. Such charges penalize the customers of these two operators as they will have to pay more for calls to Albtelecom, thereby generating profits for Albtelecom. We emphasize that this company has been operating for more than two decades in the Albanian telecommunications market with fixed and mobile telephony and dominant positions in the fixed telephony market.

Vodafone Albania considers AKEP's proposal as unacceptable due to lack of transparency. The proposal, which AKEP intends to adopt, has not been communicated or consulted with other operators in the market, although the law clearly stipulates that any regulatory measure affecting their operators and clients applies only after a public and transparent consultation.

Pending a response and correct behavior by AKEP, Vodafone Albania states that in no case will it accept any decision that is not in full compliance with the EU regulatory framework and legislation for the electronic communications sector in Albania, and more that violates the rights of our customers. Vodafone Albania is committed to follow all the necessary legal procedures at both national and European level to such a decision.

Pronouncement from Telekom Albania on the situation with AKEP
Telekom Albania has faced these days with several articles in the written and electronic media, according to which AKEP is preparing the market analysis of mobile services market in terms of interconnection termination rates among operators. This decision determines the asymmetry (ie the unequal level of charging between operators) and makes a distinction in the implementation of non-discriminatory regulatory measures for the prices of calls within and outside the network between the operators, thus favoring Albtelecom significantly.

Telekom Albania urgently requested AKEP, through an official communication, to implement the legal standard of public consultation with all stakeholders, judging that the draft decision in the reported form undermines the legitimate economic interests of our company, which is undoubtedly one an important factor in the market and one of the largest, long-term investors in the country.

In this context, we are surprised by the lack of a response by AKEP, as would normally be expected from a public institution, where information and transparency to the public is a fundamental obligation. However, we expect a more cooperative and constructive approach to restore communication according to international practices, in the interest of the general interest. Telekom Albania states that it will protect the legitimate interests of the company, and above all of our loyal customers, taking every necessary step.
